ABOUT

José M. Luzarraga is a partner in the Dallas office of Hartline, Dacus, Barger, Dreyer & Kern, LLP. He is a trial lawyer that focuses on product liability and business litigation. He has tried cases and represented clients in a variety of trial and appellate courts as well as alternative dispute resolution forums. He has represented automobile manufacturers in litigation involving airbags, restraints, handling and stability claims, and rollovers. In addition, he has represented clients in prosecuting and defending claims in numerous commercial contexts, including contract disputes, fraud cases, insurance coverage issues, class-actions, trademark and patent disputes. He has represented and counseled a wide variety of clients including airlines, defense contractors, energy companies, insurers, real estate developers, and telecommunications’ providers.

CASE EXPERIENCE

  • Successfully obtained two defense verdicts in two SUV rollover cases involving multiple deaths.
  • Successfully obtained summary judgment in a multi-million dollar insurance coverage case involving an international scandal arising from a NATO imposter. Mr. Luzarraga also handled the appeal of the summary judgment which was affirmed by the United States Fifth Circuit Court of Appeals. (Federal Insurance Co. v. ACE Property & Casualty Co., 429 F.3d 120 (5th Cir. 2005)) .
  • Successfully obtained dismissal of two cases without payment of any money by the defendant involving fraud and breach of warranty claims by two different trucking companies that claimed that more than 140 heavy duty trucks were defective.
  • Successfully obtained summary judgment in an SUV rollover case involving a fatality, and then handled the appeal of the judgment that was affirmed by the Thirteenth Court of Appeals in Corpus Christi, Texas.
  • Represented an insurer in an arbitration involving more than $15 million in claims arising from a fire at a chemical plant in Convent, Louisiana.
