Kurt C. Kern
ABOUT
Kurt Kern is a founding partner in the Dallas office of Hartline, Dacus,
Barger, Dreyer & Kern, L.L.P. He began his legal career, long
ago in a galaxy far away, as an associate in the litigation department
of Strasburger & Price, LLP. He became a partner there before
helping form HDBDK in 1994.
After earning his undergraduate degree from world-renowned, independent
Hillsdale College in Hillsdale, Michigan (for better or worse, known as
the most Republican school in this nation) and his law degree from Southern
Methodist University in Dallas, Texas (his adopted home state), Kurt
has focused almost exclusively on the defense of corporations involved
in product liability, toxic tort and premises liability matters, with a
concentration in automotive products liability. During his career,
Kurt has taken well over 50 cases to trial in Texas courts, as well as
other state and federal courts.
CASE EXPERIENCE
- Successfully obtained
a defense verdict in an automotive crashworthiness case involving quadriplegia
(San Antonio, 2007).
- Successfully obtained a defense
verdict in an automobile fatality rollover case (Houston, 2007).
- Successfully obtained a
defense verdict in a forklift case (Houston, 2006).
- Successfully obtained a defense
verdict in a crashworthiness case arising from a rear impact that resulted
in the death of the driver (Austin, 2006).
- Successfully obtained a defense
verdict in a crashworthiness case involving a 6 year old ventilator dependent
quadriplegic (Huntsville, 2006).
- Successfully obtained a
defense verdict in a products liability, negligence and misrepresentation
suit arising from a rollover accident (Odessa. 2006).
- Successfully obtained a
defense verdict in a products liability and negligence suit arising
from a rollover accident wherein the plaintiffs claimed the vehicle
was defective because it was susceptible to untripped rollover (Houston,
2005).
- Successfully obtained
a defense verdict in a handling and stability and seat belt case involving
two deaths and brain damage (Houston, 2005).
- Successfully obtained
a defense verdict in a strict liability, negligence and breach of
warranty suit involving alleged seatback failure (Edinburg, 2005).
- Successfully obtained a
defense verdict in a double fatality rollover case (San Antonio, 2005).
- Successfully obtained
a defense verdict in a fatality products liability suit involving claims
that the vehicle was defective because the side-curtain air bag and
side door air bag did not deploy during the accident sequence (Dallas,
2004).
- Successfully obtained
a defense verdict in a products liability suit involving the front
seat system of a sport utility vehicle (San Antonio, 2003).
