David W. Green

ABOUT

David W. Green is a partner in the Corpus Christi office of Hartline, Dacus, Barger, Dreyer & Kern, L.L.P. He began his career in 1982 in the San Antonio City Attorney’s Office, Trial Section, defending personal injury and death claims, automobile collision cases, products liability claims and cases arising under the Texas Tort Claims Act.

Since that time, his practice has included the defense of clients involving personal injury and death claims based upon negligence and products liability related to explosions, electrical fires, falls, medical devices, toxic substances, pharmaceuticals, dram shop liability and various other claims.

Mr. Green is also involved in commercial litigation, including the defense of claims for breach of contract, fraud, misrepresentation, inverse condemnation, consumer protection, deceptive trade practices, insurance coverage, and insurance agent’s liability.

He also enjoys that part of his practice involving appellate law. Mr. Green has prepared appellate briefs and argued before the courts of appeals on issues which include premises liability, personal injury/death, “tort claims act”/municipal liability, deceptive trade practices, workers compensation, and contractual indemnity.

CASE EXPERIENCE

  • Has successfully defended and tried a variety of cases involving automobile collisions, premises liability, and general negligence on behalf of the local transit authority, various municipalities, and transportation companies.
  • Successfully tried a number of cases for a well known yellow page company in state and federal court involving claims for breach of contract and violations of the Texas Deceptive Trade Practices Act.
  • Successfully defended the appeal of the granting of his own Motion for Summary judgment in a “tort claims” case on behalf of a south Texas municipality.
  • Successfully defended the appeal of a premises liability/death case, involving fall protection on a construction site, in which our firm had obtained a jury verdict for the defense.
  • Recently obtained a multimillion dollar summary judgment in favor of a client on a contractual indemnity claim.
